A better question is will the evidence stand up to physics. I'm assuming that speed will be based on engine RPM and the gear you're in. Even if the RPM is accurately recorded to the nearest 1 RPM, the size of your tires and the pressure, and the gearing of the differential (which may have been changed since the car was new) will all affect your actual speed. Road conditions may also play a role. I know for a fact that on slippery surfaces the speedometer can read 50 while you're sliding backwards at 10 or 15 mph. > The real test will be whether the courts will consider > electronic emanations to be in "plain sight" of the officer's information > retrieval device. I'm sure this recent ruling in New Jersey will interest you since it comes close to dealing with that question: http://www.philly.com/mld/inquirer/n...y/12282325.htm -- Steve The above can be construed as personal opinion in the absence of a reasonable belief that it was intended as a statement of fact.
